ABOUT OUR MANAGING DIRECTOR

David W. Bates

Managing Director, Ross, Lynn & Associates

Timeshare Dispute Resolution Specialist since 2000

Former (NCA) Private Timeshare Mediator

I've spent 26 years in timeshare dispute resolution, first as a neutral mediator between owners and resorts, and since 2011 on the owners' side. Along the way, I've worked with more than 7,500 timeshare owners.

I've sat at the table as the neutral party.

For years, I worked as a private, non-court-appointed mediator between timeshare owners and resorts. As the neutral party, I heard both sides: what resorts needed to see before considering a release, and what owners usually didn't bring.

The pattern repeated. Owners arrived with a purchase agreement and a story. Resorts arrived organized. The owners who had a clear written record of what they were told, and how it differed from what they signed, were the ones taken seriously.

In 2011, I chose a side. I founded Ross, Lynn & Associates to work for owners, and I built my framework around what mediation taught me: get your records organized before anyone contacts the resort.

- I'm no longer a neutral mediator. I'm on your side!

How I work today

I handle every client personally. There's no call center and no case manager between us. When you call, text, or email, you reach me, and I'm never billing you for it. I update every client myself, once or twice every 30 days.

I start with your records, not a retainer. Most owners have no documented record of what they were told at the sales presentation. I help you organize what you have, in your own words, so you can seek a release directly with the resort, and so any attorney you might ever need starts with a documented file instead of an empty folder.

Over the years, I've built working relationships with consumer protection and timeshare attorneys across the U.S., and many of them ask for my counsel on their own clients' cases. That's the part of my work I'm proudest of: the people who see these files every day trust how I prepare them.

"I'm not a law firm or an exit company, and I'll tell you that on our first call. I'm the best alternative at a fraction of the price.

If your situation is outside what I can help with, I'll tell you that too."

The owners I work with

Most owners who call me are still making loan payments. The rest have paid off their timeshare and are left with the maintenance fees. Many are at or near retirement, and many have already paid an exit company or sat through another sales pitch that went nowhere. They're tired of being sold to.

I get that, which is why the first thing I do is listen.

Type of questions I'll ask you on our first call

I don't start with your purchase agreement. I start by understanding why you're seeking to exit your timeshare: hardship or misrepresentation?

What was verbally promised versus what you actually signed?

1

Did the salesperson describe your timeshare as property that would go up in value? Or did they tell you it's a membership, there's no resale potential, and you lose 98% of your investment?

2

Did they tell you the price was only available that day? Or did they tell you the same kind of timeshare can be purchased on resale websites, sometimes for as little as $1.00?

3

Did they tell you your maintenance fees would stay the same? Or did they explain that fees can rise every year?

- In my experience, they often go up 5% to 7% a year, which doubles them in roughly 10 to 14 years.

Your answers, in your own words, show me whether there are discrepancies between what you were told and what you signed. That tells me quickly whether I can help, and if I can't, I'll tell you.

Company Status and Scope of Services: Ross, Lynn, and Associates, LLC ("RLA") is a private, non-court-appointed dispute resolution firm. RLA prepares pro se discrepancy dossiers for timeshare owners and, at your request, facilitates direct resolution discussions with your resort. When RLA has prepared your dossier, RLA participates as your resolution facilitator, not as a neutral mediator. RLA is not a law firm and does not provide legal advice, legal representation, legal strategy, legal opinions, or interpretations of contracts or statutes. Nothing on this website, in our educational articles, or in any dossier, report, or correspondence RLA prepares is legal advice or creates an attorney-client relationship.

No Affiliation: RLA is not affiliated with, endorsed by, or acting on behalf of any timeshare developer, resort, management company, or lender. Any resort or company names that appear on this website are used for identification purposes only and do not imply any relationship or endorsement. Listing a resort does not suggest that the resort, its developer, or its staff has done anything wrong.

How Our Services Work: RLA works only from records and information you provide. RLA does not contact resorts, management companies, or lenders, and does not request records from them, except in a resolution discussion you have authorized in writing. A discrepancy dossier organizes significant contradictions between the verbal sales statements you report and your written purchase records. You write and sign your own statements. RLA does not add claims or draw legal conclusions. If you choose the dossier-only option, you represent yourself (pro se) and contact the resort directly. If you choose resolution facilitation, you do so only with your written consent, and only if the resort agrees to take part. In either option, you remain self-represented, and RLA does not act as your legal representative.

Your Right to Act on Your Own: You do not need to hire RLA or any other company to address your timeshare. You may contact your resort, developer, or lender directly, at no cost, to ask about cancellation, surrender, deed-back, or other options. You may also contact a licensed attorney of your choice at any time.

No Guarantee of Results: RLA does not guarantee any outcome, including contract cancellation, debt reduction, release from obligations, or any response from a resort or lender. Results depend on your records and circumstances and on third-party decisions.

Testimonials and Reviews: Any testimonials, reviews, or experiences shown on this website reflect the individual experiences of those owners. They are not necessarily typical, do not guarantee or predict any result, and your results may differ.

Financial and Credit Risk Disclosure: RLA does not advise, suggest, or direct you to change, pause, or stop payments owed to any timeshare developer, resort, management company, or lender. Any decision to pause, change, or stop payments is your own choice. That choice may lead to negative credit reporting, collection activity, legal action, and continued financial liability.

Educational Content: Articles, guides, and other content on this website are general educational information about timeshare ownership. They may not apply to your specific situation, may not reflect the most current laws or resort policies, and are not a substitute for advice from a licensed attorney.

Independent Attorney Directory Disclaimer: RLA offers a free directory of independent, third-party attorneys who handle timeshare contract matters. The directory is for information only. RLA does not endorse, recommend, or vouch for any attorney listed. RLA receives no referral fees, fee-sharing, or anything else of value from any attorney or law firm, and has no partnership or joint venture with any of them. RLA lists only independent attorneys in its directory who have confirmed that their fee to take on a matter with a completed discrepancy dossier will not exceed $1,500. Each attorney sets their own fee within that limit. You should check an attorney’s license and standing with the state bar before hiring.

RLA’s Legal Fee Coverage Promise applies only to attorneys in this directory. Under that promise, if your discrepancy dossier does not lead to a voluntary surrender or mutual release agreement, RLA will reimburse you for the attorney’s fee, up to $1,500, as set out in your written services agreement. You pay the attorney directly, and RLA sends you a check for the amount charged, up to the cap. You remain free to hire any attorney you choose, but the reimbursement applies only to attorneys in this directory.

Choosing to hire an attorney is your own decision. Any attorney-client relationship is solely between you and the attorney, and the attorney’s legal work is separate from RLA’s dossier and facilitation services.
